Establishing paternity is crucial in determining whether the parent has a right to child support and custody. If paternity is established, both parents have a legal right to get a child support order. A child support order specifies the amount and type of support the parents must provide for their children. The amount of child support is determined by the parents’ incomes, the number of children in the marriage, and basic costs of raising a child. Child support can also include providing medical and dental insurance for the child.
There are several ways to establish paternity – first, if the parents are married to each other when the child is born, paternity is presumed unless otherwise disproved. Paternity can also be established through an administrative order from the Florida Department of Revenue based on DNA test results, or by a court order.
